At the Interim hearing, the judge raised serious concerns with the mother's mental health and ability to care for the children but because she continued to commit to her allegations the judge stated that due to allegations made he was compelled to follow legislation and effectively remove the children entirely out of my care, granting me only supervised visits, until trial. The mother is ordered to seek support from mental health care practitioners and see a psychologist selected by the ICL. We both have to partake in psyche evals and family report interviews before trial.

I've exhausted all my savings just getting to this point and I still have to pay for the psyche evals and all costs related to supervised visits with the children. Fortunately my matter has been granted access to the Cross-Examination of Parties Scheme which should cover my legal costs for the trial, but I am also going to withdraw additional funds from my mortgage because I won't have the funds to cover all the costs along with full child support during this time.

I don't know how much influence I have with the matter at this point but I am reaching out for any advice people can offer in giving me the best chance of succeeding. The evidence is considerably favorable towards me and condemning for the other party, despite it feeling flipped at this moment. I only seek constructive advice from those willing. Thanks.

All lawyers suggested a man cannot win, there is nothing to help a man. There is nothing a father who with evidence and witness could do. 

Fathers have no right here, children views matter nothing. Cheating is fine but raising concerns on ongoing cheating and family violence by men is a crime.

• She attacked me, it was caught on video, QPS issued a DV Order against her.
• 3 days later, she lodges private DV Orders, I get Ousted from our home which was also my place of business.
• 6 months later, we do the divorce settlement, I give her funds to pay cash for a house, she gets kids 66%.
• 2021, I lodge back in Family Court seeking 100% care of kids due to her ongoing false allegations against me and general mischief making.
• 2024, Family Court Order me 100% care of kids. Psyc report indicates sexual abuse of children which her present, her coaching kids etc. Pychiatrist report indicates mental health concerns.

My losses as a result of the above, which includes over 60 appearances in both DV & Family Courts, is now in the 7 figures.

Our kids now have complex mental health issues and will require therapy for some years to come, which I will have to fund.

Looks like Final Hearing will occur in Feb 2025, unsure yet if I will be awarded costs.

Wondering if I can sue her for damages incurred?

Would love to sue the DV Court Magistrates and/or Qld government due to harm they caused to both myself and the kids, but I expect that would go no where.

My ex wife has made false allegations against me and I have nowhere to live. I am NSW. 

I don’t know know what to do. I need urgent help.

I agreed to go on the waitlist for the course in order to see my children, however I am wondering if this course is something that my former partner can use against me in the family court?
